Statute of Limitations for Sexual Assault Claims
There is a three-year statute of limitations to file a claim for civil lawsuits involving sexual assault.
This deadline begins on the date that the sexual assault happened or was discovered. This also applies to sexual abuse cases before June 6, 2024. For sexual abuse cases after June 6, 2024, there is no statute of limitations for filing a civil lawsuit.
There is no criminal statute of limitations for sex crimes involving children. For criminal cases against individuals 16 years old or older, there is a 20-year statute of limitations.
